SIREN PRIVACY NOTICE

This Privacy Notice explains how we collect, use, process and store your Personal Data when you use any of our products and services, including applications, Siren’s services and solutions, or visit our mobile application or any of our websites (collectively referred to as “Services”). This Notice also explains how we collect, use, process and store the Personal Data of third parties provided by you in connection with your use of our Services. For the purposes of this Notice, the term “Personal Data” includes such third party Personal Data where applicable.

This Notice applies to the processing of Personal Data that relates directly or indirectly to you or the individual that data relates to, from which you (or that individual) may be identified as an individual, and includes sensitive personal data. Personal Data includes your name, home and work address, contact details, email address, medical profile, vehicle information as well as less obvious data like demographic data, device-related data, app utilisation records, chat history, online identifiers and location data in so far as they are personally identifiable.

Please read this Notice in context with the Terms & Conditions of the service that you use. It may set out additional service-specific terms regarding your Personal Data which we collected from you or which you provide, and the related processing activities.

CHANGES TO THIS PRIVACY NOTICE

As part of our ongoing commitment to transparency, we’re updating our Privacy Notice to empower you to make the best decisions about the information that you share with us.
By using our Services on or after such policy update, you’ll be agreeing to these revisions. You should read the documents in full.
1. WHO ARE WE?
Siren Networks Sdn Bhd (referred to as “Siren”, “us” or “we”) is a communications technology company that provides, and always strives to improve ways for you to communicate with other Siren users in a secure and reliable manner. Our mobile application provides you with a convenient platform for organizing and storing your emergency contacts and critical information, connecting you with other Siren users through our alarm and alert system where you can safely share your critical information including your location and medical information with your verified contacts within our platform, at a press of a button, at your discretion. Siren may work with partners, service providers, and affiliated companies to help us provide ways for you to connect with their services.
2. WHAT IS THE LAWFULNESS OF PROCESSING?
Siren will process your Personal Data based on:​

The performance of a contract and to take steps prior to entering into a contract. Including for our legitimate interest, namely for administrating the Services, maintenance and development of our Services, and for communicating with you effectively.​

Legitimate business interests, for example, fraud prevention, authentication, maintaining the security of our network and services, direct marketing, and the improvement and customization of our services. Whenever we rely on this lawful basis to process your data, we assess our business interests to make sure they do not override your rights. Compliance with legal obligations, including accounting and tax requirements, and any lawful request from the government or law enforcement officials.

3. WHEN DO WE COLLECT YOUR PERSONAL DATA?
We collect your Personal Data in three ways;

Feedbacks, opinions, reviews, comments any information you may share with us on our social media platform, internal communication platforms and websites.

Siren only collects and process Sensitive Personal Data when you voluntarily provide us this information or where such information is required or permitted to be collected by law. For instance, personal religious beliefs, racial or ethnic data, medical history and condition and your GPS location when you use our Services, where such information may be sensitive but important to your identification and response to your personal emergency.

You consent to and agree that by the sharing of such Sensitive Personal Information with your emergency contacts, with us or affiliated companies for your use of our Services, and with third-party service providers that you choose to engage through our platform, you expressly consent to such provision, use and processing of your Sensitive Personal Data and Siren shall not be liable for any losses, damage, claims, costs, expenses or liability whatsoever arising from the collection, use or processing of such Sensitive Personal Data.

In some circumstances, we may de-identify, aggregate or anonymize any of the sensitive personal information we collect (so that it does not directly identify you) and use it for purposes that include improving our Services, testing our IT systems, research, data analysis, developing new products and features.

We may not be able to process your application and/or provide you with our Services for reasons such as:​​
1. If you fail to supply us with the necessary Personal Data;
2. If the Personal Data supplied is incomplete and inaccurate or not updated; and/or
3. If you withdraw your consent for us to process your Personal Data.

In connection with your requests, we may also collect appointed representative and/or guardian’s, emergency contact and/or certain third party Personal Data. Where you provide us with such information, it is deemed that you have obtained their consent to share the information with Siren and for the use and processing of such Personal Data in accordance with the terms of this Notice.

Our Services may contain links to third party websites, or enable access to third party services. We have no control over how third-party websites and services process your Personal Data and we are not responsible for their privacy practices. Please read the privacy policies of any third-party websites or services that you access using our Services carefully.

5. HOW DO WE USE YOUR PERSONAL DATA?
Siren may use and process your Personal Data for the following purposes:​

To operate, maintain and to continue to provide you functionalities and features of our Services.

To support any troubleshooting and improve our Services availability.

To develop new features or make changes to existing features and functionalities of our Services in order to improve user’s experience.

To keep you updated on the latest information relating to our Services, updates, benefits, or changes to terms of use.

To notify changes to our terms and conditions or Services interruptions.

To send you public service announcements either on our own or on behalf of any statutory and/or regulatory bodies or applicable authorities.

B. Purposes necessary for health safety and security:

For processing necessary to protect your and others’ vital health and safety and security, facilitating communication with you and your designated contacts and emergency service providers in an emergency. We may also use and process the personal data of your emergency contacts for the same purposes.​

C. To send marketing materials and personalise Services to you
i) Marketing

Where you have consented, to send you promotional materials relating to our Services, or promote the services or products of our partners or third parties which we think may be of interest to you through phone calls, SMS, emails, and push notifications.

We tailor these messages based on the Services you’ve subscribed from us in the past, or information we have from third parties.

ii) Targeted advertising

To target our marketing and advertising campaigns (and those of our partners) more effectively and to make your online experience more efficient and enjoyable. This is known as interest-based advertising. It can be on websites, in-app or other channels belonging to Siren or other organizations, as well as other online media channels such as social media sites. We may also combine data collected via cookies with other data we have collected about you.

Opting out of interest-based advertising does not stop advertisements from being displayed – it is just that they would not be tailored to your interest. To stop receiving personalised advertising on your social media, go to the relevant platform’s ad settings.
D. To conduct research and analysis

To research, monitor and analyse customer use of our Services on an anonymous or individual basis, to identify general trends, conduct market research or surveys, internal marketing analysis, customer segmentation, develop new services, and improve our understanding of our customer’s patterns, behaviours and choices.

To create, study and share aggregated and de-identified data sets of our user base demographics with our affiliates and business partners, for purposes including, but not limited to identifying any trends, patterns and associations that may help enhance the security, optimise our Services and for research and development of new products and features that are suitable for our Users.​

E. To carry out authentication, fraud prevention and security measures

To carry out authentication when you register for any Services with us.

To exchange information about you with credit reporting agencies while you have a relationship with us. This includes your settled accounts or any outstanding debt you have with us. This information may be supplied to other organisations by the credit reporting agencies.

ii) Fraud prevention and security

To verify your identity when you request access to your account and general account management purposes. We sometimes supplement the information we collect about you with information from other sources to assess the accuracy of the information that we hold.

To detect and resolve fraudulent use of our Services

To prevent and stop potential cyber security threats to our internal systems, network and Services.

To protect your account from unauthorised access, fraud, misuse or damage to our Services.

To investigate suspicious account activity or transactions when you use any of our Services.

6. WHO DO WE SHARE WITH?
We may share information about you with the following parties

Your emergency contacts: We share your personal information including your name, profile information, medical and other condition and location with your verified Emergency Contacts when you signal your emergency alarm in the application. Your location and your profile information are shared with them as long as the alarm remains active and it ends when you end the emergency alarm. A responder’s location will not be disclosed but the distance between the responder and the signalling user will be shown.

Affiliates: We may share your Personal Data with Siren and affiliated companies for processing activities listed in ‘How Do We Use’ section above.

Service providers, vendors, suppliers: we contract with authorised external parties or companies that provide products and services to us such as information technology security and support. We work with partners to facilitate our Services, including IT vendors who manager our systems, third-party applications or social networks that you have chosen to link with our Services, to the extent of enabling you of using these Services

Third-party service providers: We may share personal information with authorized third-party service providers of certain services that you choose to engage on our platform. For example, we may provide your personal information and location data to emergency responders which you choose to engage. We also share personal information with third party partners that provide services and features available through subscriptions. The third parties that provide subscription service features may ask you for additional information in order to provide the full range of services to you. Any information provided to these third parties will be governed by that third party’s own privacy policy.

Marketing Partners: We may share your de-identified or anonymized Personal Data with marketing and advertising partners to provide users with more tailored content and better service.

Researchers: We may share your de-identified or anonymized Personal Data to third parties for research or statistical analytics purposes to help us understand how you use our Services and how we can improve our Services for you.

Professional Advisors & Investigators: We engage professional advisors on matters relating to our Services, including legal advisors, accountants and auditors. We will also release information to fraud investigators if it’s reasonable for the purpose of protecting us against fraud, defending our rights or property, or to protect the interests of our customers.

Law Enforcement: We may also need to release your Personal Data to comply with our legal obligations and to respond to the authorities’ lawful demands. Your Personal Data shall only be provided in good faith, when we are obliged to do so in accordance with the law and pursuant to an exhaustive evaluation of all legal requirements.

Other Parties: If you are involved in or related to a legal proceeding, or if our company is reorganised or sold to another organisation, we will provide your Personal Data to the relevant parties.

We may also share information about your emergency contacts when you signal your emergency alarm in the application. Their distance from you will be shared with you and the other attending emergency contacts as long as the alarm remains active and it ends when you end the emergency alarm. Messages exchanged with your emergency contacts may also include your and/or their personal information, over which we have no control or responsibility. You warrant that you have obtained the consent of such emergency contacts for the use and processing of their Personal Data pursuant to this Privacy Notice.

Where you buy a third-party product or service independently and/or through your Siren account, the contract is with the party selling that product or service. As part of this, you are agreeing that Siren may pass certain Personal Data (for purposes listed in ‘How Do We Use’ section above) to such parties to complete your purchase. The seller’s terms and conditions, privacy policy, and cookie notice will apply as to how they use your Personal Data – please read them carefully.
When we share your Personal Data, we will take steps to ensure that the recipient will protect your privacy, keep your Personal Data secure and process it in accordance with applicable law and this Privacy Notice.

We will not sell the Personal Data that we process about you to third parties without your consent.

7. HOW LONG DO WE KEEP?​​
A. We keep your Personal Data as long as we need to fulfil the purposes for which it has been collected. We retain Personal Data only:

for the period required to serve applicable purpose(s) set out in this Notice;

to the extent necessary to comply with an applicable legal requirements; and/or

as advised by local laws.

B. Promptly after applicable retention period has ended, your Personal Data will be appropriately:

de-identified (through removal of identifiable components, obfuscation, pseudonymisation, anonymisation, or any other means); and/or

transferred to an archive (unless this is prohibited by applicable data protection related laws).

8. HOW DO WE PROTECT?​​

We are committed to maintaining the security of the Personal Data Processed and restrict the Processing of Personal Data to those data/information that are reasonable, adequate for, and/or relevant to the purposes listed in the “How do we use” section above.

To protect your Personal Data, we take appropriate measures, and we also require our external parties to protect the confidentiality and security of your Personal Data. Depending on the nature of the data or information to be protected, we constantly review and improve our measures to protect your Personal Data from risks such as destruction, loss, misuse, unauthorized modification, and unauthorised disclosure of or access.

9. DO WE TRANSFER?
When we need to transfer your Personal Data to countries outside Malaysia for processing purposes, we will take appropriate steps to ensure that your personal information is adequately protected (for countries that may not provide the same level of protection as Malaysia). This may include having agreed terms and conditions for such data transfer and carrying out reviews of any recipients to ensure that Personal Data in that country will not be processed in a manner which would contradict applicable data protection laws in Malaysia. You confirm that you have consented and have procured the consent of your emergency contacts to the transfer of your/their Personal Data to countries outside Malaysia for processing purposes.

10. WHAT ARE YOUR RIGHTS?
You have rights in relation to the Personal Data that we hold about you. Your privacy rights include:​

Modify your account information: you may modify your account information, update or amend your personal information, or change your password at any time by logging in to your account.

Close your account or delete personal information: We retain your information for as long as your account is active or as reasonably necessary to maintain the Service, meet legal, tax and accounting obligations, and for the other purposes described in this Privacy Policy. If you wish to close your account, and/or request to delete your personal information, please contact us at hello@siren-app.com . When account information is deleted or de-identified, certain residual information may remain within our archive records, such as for customer and technical support, billing and tax purposes or legal purposes.

Emails and notifications: You can control your receipt of email and text alerts by visiting “Settings” and “Notifications Settings” within the mobile app. You can also stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in such communications. You may not opt-out of Service-related emails (e.g., account verification, parental consent notification, order confirmations, change or updates to features of the Service, technical and security notices). We make every effort to promptly process all unsubscribe requests.

Location and Movement Data Collection and Sharing: As described above, we collect your location data (and that of your emergency contacts where required for the Services), and may share your personal information, including location and movement data, with your verified emergency contacts and with third parties service providers that you have chosen to engage through our platform. You have many options to control this data collection and sharing activity through your phone’s setting.

Right to withdraw consent: At any point of time, you have the right to withdraw your consent to us to use, process or share your Personal Data or that or your emergency contacts by writing us at hello@siren-app.com. However, withdrawing your consent will result in us not being able to provide you with our Services.

Right to access your information: At any point of time, you can request a copy of the Personal Data that we hold about you by contacting us. Kindly note we may need to verify your identity for that purpose and will make every effort to promptly process your requests and an administrative fee may applicable. You may also correct your Personal Data.

To ensure that the Personal Data we hold about you is correct and up to date, we may from time to time contact you to verify the accuracy of your Personal Data (including that of your emergency contacts) in our record. However, it is your responsibility to ensure that you provide us with true, accurate, updated and complete information.

11. WHAT ABOUT CHILDREN?
We take special precaution to protect the privacy of our younger users. We do not knowingly collect personal information from children under the age of 18 (a “child”) without verifiable consent of a parent or guardian and the Service is intended to be used by children under 18 only with significant parental involvement and approval.

If Siren learns that we have inadvertently collected personal information of a child without parental consent, we will take appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 18 has a registered account with our Service without your consent, please alert us immediately by emailing hello@siren-app.com so that we may delete that child’s personal information from our systems.

By enabling your child to create a user account and permitting your child to use the Service, you expressly agree to the practices described in this Privacy Notice and you consent to the collection, use, and disclosure of your child's personal information as described herein.

Setting up a child account. A person under the age of 18 years old will not be able to register an account with us without parental or guardian consent. However, If the parent or legal guardian wishes to create an account for the child, we request the Parent or legal guardian to provide us with a verifiable consent by reaching out to us. The child will then be able to participate in most aspects of the Service.
Personal information we collect. We take special precautions to collect only as much information as is reasonably necessary for the child to use the Services. As further described in our Privacy Notice , we collect various types of personal information from all users of the Services. For example, we collect profile information (username, email address and mobile phone number) when a user creates an account and other types of personal information the user may provide during the course of using the Services, such as a nickname, and emergency contact information. We collect information about a user’s device (e.g., IP address, device type/model/manufacture / operating system, and a unique ID that allows us to identify the browser, mobile device or account) as well as certain usage information about the use of the Services (for example, whether the user opens emails) and we collect analytics data. We collect geolocation data through GPS coordinates available through the user’s mobile device. Please review the section of our Notice called “What do we collect” to learn more.
Information sharing. Siren may share or disclose a child’s personal information to our third party vendors, service providers and business partners as described in our Privacy Notice, including, for example, with third parties as needed to perform analytics or otherwise, support the features and functionality of our Services. However, we do not share personal information collected from the accounts of children under 18 for marketing or advertising purposes, nor permit our third party partners to collect and use such information for advertising purposes. Please review the section of our Privacy Notice called “How do we Use” and “Who do we share with” to learn more about how we share information with our vendors, service providers and others.

Sharing information with other Siren users. The child’s profile information and location will be shared with his/her emergency contacts. Please note that if your child adds any emergency contacts, the child will be able to share his or her location with these emergency contacts and may exchange messages with these users. You are responsible for monitoring your child’s account and location-sharing activity through the Service and for blocking or permitting location sharing features.

Your Choices.

Contact Us. The Parent has a right to request to review or have deleted the child’s personal information and may withdraw consent for the Service to collect any further personal information from the child. Please contact us at hello@siren-app.com to request to review and/or delete any personal information we have collected from the child, or to withdraw permission for Siren to collect any additional information from the child. Please also review the section of the Privacy Policy called “What are your rights” to learn more about how you may control or turn off certain data collection and sharing features of the Service.

12. CHANGES TO THIS PRIVACY NOTICE
Siren reserves its right to amend this Privacy Notice from time to time based on changes as per the business, legal and regulatory requirements and applicable laws. We encourage you to revisit this notice periodically, allowing you to see any changes made by checking the effective date above.
